Bankruptcy legislation being consolidated

The Bankruptcy (Scotland) Bill, prepared by the Scottish Law Commission, has been introduced in the Scottish Parliament.  The Bill consolidates the Bankruptcy (Scotland) Act 1985 and subsequent legislation on bankruptcy.

The 1985 Act has been so heavily amended, on so many occasions, that it has lost coherence and rational structure.  Many of its provisions are inordinately long, and numbering has become complex and unwieldy.  The consolidation Bill simplifies the structure so as to make it easier for practitioners and those affected by it to use, thereby saving time and money.
