The SLC welcomes views on the draft Judicial Factors (Scotland) Bill

Given the increasing number of judicial factor appointments in recent times, the Commission’s work on modernising the law on judicial factors could not have come at a more appropriate time. The context in which contemporary judicial factor appointments are operating differs considerably from the context in which the existing legislation was implemented in the late nineteenth century. With this in mind, following various periods of consultation, we have produced a draft Judicial Factors (Scotland) Bill, the most recent version of which is now available online for consideration. In addition, we have published a number of questions relating to the costs and benefits of our recommended reforms. The answers to these questions are critical to the business and regulatory impact assessment we are required to submit. Comments and views on any aspect of the Bill and/or in response to these questions are welcomed.
