Major review of mortgage law: Discussion Paper on Heritable Securities: Default and Post-Default

The Scottish Law Commission has published a Discussion Paper on Heritable Securities: Default and Post-Default today. 

The Discussion Paper is part of our wider project on mortgage law in Scotland and provides a systematic review of the process by which mortgages are exercised to enforce debt.

The Commission is very keen to hear from everyone with an interest in the issues raised in the Discussion Paper. The consultation is open for comment until 1 April 2022.
