Tenements owners' associations: learning from other countries

The Scottish Law Commission is hosting an international comparative law webinar series in September 2022 as part of our project on Tenement law: compulsory owners’ associations.

Join us as we tune in to hear about the law of flat maintenance and management in different countries from experts in the field and ask: what can we learn from this?

The Commission received a reference from the Scottish Government in January 2022 to make recommendations for legislative reform with regard to establishing compulsory owners’ associations in tenement properties. The introduction of owners’ associations was one of three recommendations made by the Scottish Parliamentary Working Group on Maintenance of Tenement Scheme Property in its report of June 2019 to address the poor condition of Scottish tenement stock.

The webinars provide an opportunity to hear about the experiences of countries where owners’ associations are a familiar part of apartment law. The series will include discussion from legal experts in England, Australia, Spain, Poland, and Portugal.

There are three webinars within this series:

(1) Lessons from England: what not to do when reforming the law of the tenement

(2) Lessons from Australia: when owners’ associations go too far

              Professor Cathy Sherry, Macquarie University (Sydney, Australia)

              Wednesday 21 September 2022 between 09.00 and 10.00.

(3) Lessons from Europe: how to enforce payment for tenement maintenance

At each event speakers will discuss the law of their country, examining key issues and highlighting the lessons we can learn when drafting our own proposals. The events will finish with a Q&A session for participants to engage with the speakers and probe deeper into chosen issues.
