Contract (Formation and Remedies) (Scotland) Bill

We are delighted that this Bill has been passed by the Parliament.  The Bill implements our 2018 Report on the Review of Contact Law: Formation, Interpretation, Remedies for Breach, and Penalty Clauses.  We are very grateful to Professor MacQueen, who was the lead Commissioner for this Report, for his continued assistance in the implementation of this Report.

This is the fourth Bill implementing a Commission report to be passed by the Parliament this session.  The others are: 

• Moveable Transactions (Scotland) Act 2023
• Trusts and Succession (Scotland) Act 2024
• Judicial Factors (Scotland) Act 2025 

We welcome the ongoing implementation of the Commission’s reports and hope that this progress will be sustained.
